As we mentioned above that Article 27, paragraph 3 (b) authorized Member States in the WTO exception for plants innovations from protection by the patent. However it has imposed Article 27, paragraph 3 (b) to the Member States in the World Trade Organization to protect new plant varieties either by: patent, or a unique system of a particular kind of plant variety protection, or any combination thereof. It is then committed to the Member States in the World Trade Organization to the protection of plant varieties innovative, but have the option to protect either by a patent, or by a unique system of a particular kind of plant variety protection, or through a system that blends innocence and unique system for your protection.
